These terms and conditions relate to the conduct of training events by Offroad 4WD training & Tours. They apply to all course participant and their passengers.
Drivers participating in an Offroad 4WD Training & Tours training event must hold a valid driver’s licence for the class of vehicle thay are operating and abide by all condition of their driver’s licence ast all times.
The driver and all passengers in each vehicle must be wearing seatbelts at all times. Road rules apply while driving in the park and drivers are responsible to ensure all passengers abide by this condition.
Recreational four wheel driving is hazardous, and exposes you to risk of property damage or loss or personal injury by voluntarily participating in these activities while on the property.
Other course participants may have varying levels of competence and any driving should therefore take this into account. You enter the property at your own risk.
Insurance carried by Offroad 4WD Training & Tours and/or the property owner in respect of any liability which might arise out of our involvement in the event will be limited and that, whether you are using your own vehicle or that belonging to another, third party and public liability insurance (if any) will not cover you for losses, liabilities or personal injury.
The property used by Offroad 4WD Training & Tours may contain natural hazards. Children must always be supervised by parents or guardians, especially when around any water hazards or while vehicles are in motion.
Course participants must review and understand the risk assessment provided by Offroad 4WD Training & Tours at the commencement of a training event and will indemnify Offroad 4WD Training & Tours against all claims, demands or actions whatsoever caused directly or indirectly by our actions whilst within the boundary of the property and its access road starting from Carneys Creek Road.
Offroad 4WD Training & Tours will not be liable for any action. Course participants and their passengers agree to not make any claim, demand, or action against Offroad 4WD Training & Tours in respect of:
- Any damage to or loss of property.
- Any personal injury or death suffered in or about the property used by Offroad 4WD Training & Tours whether such injury or death arises directly or indirectly out of any act (whether intentional or unintentional), negligence, default or omission on the part of Offroad 4WD Training & Tours, their servants, agents, employees, invitees or licensed subcontractors;
Course participants are responsible for the way in which they drive their vehicle on the property.
Participants infringing any relevant rules or regulations or appearing dangerous may result in removal from the property at the discretion of an Offroad 4WD Training & Tours employee, volunteer or the property owner. Payment’s I have made to Offroad 4WD Training & Tours will not be refundable under these circumstances
